This Privacy Notice for California Residents (“Privacy Notice”) supplements the information contained in the Privacy Policy (the “Privacy Policy”) made available on the website located at (the “Site”). The Site is owned and operated by Marketcall (“Company,” “we,” “us” or “our”). This Privacy Notice applies solely to residents of the State of California (“Users”). We adopt this Privacy Notice in compliance with the California Consumer Privacy Act of 2018 (“CCPA”) and other applicable California State privacy laws. Any terms defined in the CCPA have the same meaning when used in this Privacy Notice. Users with disabilities who wish to access this Privacy Notice in an alternative format can contact us by calling us at: 323-410-1052; emailing us at: info@marketcall.net; or sending us U.S. mail to: 2015 Robin rd, San Marino, CA, 91108.

Categories of information we collect and how we use it

How we collect and use your information (including your personal information) is as further described below. For each method of collection detailed below, we use the information you provide to us to provide our services to you, to communicate with you, to process your request, to understand how our services are used, to improve our services, and to comply with applicable laws.

Sites and Webforms. As mentioned above, when you complete an online form on our Sites or when you complete our Webform embedded on a Third-Party Partner's website we collect and use your information (including your personal information) to respond to your request for quotes and rates for products and services offered by such Third-Party Partners. For example, you may be asked to provide your name, address, telephone number, email, and other information in order to be matched to companies and agents who may provide you a quote for their services. Or you may be asked to provide home and destination airports and travel dates so that we can show you flight and hotel options. The categories of information you can provide to us through our Sites and Webforms depends on the nature of the Third-Party Partner's products and services for which you are requesting quotes or rates.

Automatic Collection. We may also collect other information from you through automatic means such as device type, browser type, IP Address (which is treated as personal information in some jurisdictions, but which we use only to identify your geographic area and to comply with applicable laws) or other demographic and usage information. To learn more about how we collect information through technology and automatic means and the choices you can make about how we can use and collect your information through automatic means, see "Information Collection Technologies and Cookies".

Telephone Calls and Email. We may collect information from you during phone calls that you initiate to us or that we or our Third-Party Partners may initiate (on our behalf) with your prior consent to you or when you send us correspondence by mail or email. The categories of information we collect from you or that you can provide to us through calls, mail, and email depends on the nature of the Third-Party Partner's products and services for which you are requesting quotes or rates and the purpose of your call, mail, and email to us.

Offline and Other Sources. In addition, we might receive information about you from other online or offline sources and we may combine such information with the information you have provided.

Sharing personal information and disclosure

We share the information we collect from you including personal information under the following circumstances:

Quote Requests. If you submit a request for price quotes or rates for Third-Party Partner's products or services, we will share the information contained in your request form (such as your name, address, telephone number, email, information about your cars, health, travel destination, etc.) with our Third-Party Partners, which may include agents, carriers, lead aggregators, and other service providers in our network, to process and fulfill your request. The information we share with such Third-Party Partners and the information you provide directly to such Third-Party Partners (see "Third Party Links" below) will be subject to their privacy policies and procedures. Please review such Third-Party Partner's privacy policy to learn more about their information collection practices and the choices you can make about how they collect and use your personal information.

Our agreements require Third-Party Partners to secure any personal information we provide to them and limit how they can use such information. Our agreements also require these Third-Party Partners to comply with national, state, and other applicable privacy regulations. By submitting your request to us, you understand that we and our Third-Party Partners may contact you by telephone (including through automated calling or using recorded messages), text messages (SMS), email, or postal mail based on the information you provide to us, in order to process and fulfill your request or to market additional products and services that might be of interest to you.

You understand that by providing your information, you are agreeing to be contacted by us and our Third-Party Partners, even if you have opted into the National Do Not Call List administered by the Federal Trade Commission, or any similar mechanism to opt-out of receiving phone calls or email messages. If one of these Third-Party Partners contacts you and you wish not to be contacted again by that Third-Party Partner, then you should specifically make such a request with them (as noted above, see their privacy policy for how to exercise your choices with such Third-Party Partner). Please note that Third-Party Partners may maintain the information you provided via our Sites or Webforms whether or not you elect to purchase or use their services.

Service Providers. In order to provider our services to you we may share your information with our third-party vendors, suppliers, and service providers. As with our Third-Party Partners, our agreements require such vendors, suppliers, and service providers to secure any personal information we provide to them and limit how they can use such information. Our agreements also require these vendors, suppliers, and service providers to comply with national, state, and other applicable privacy regulations.

Aggregate, Non-Personal, or De-identified Information. We may share deidentified aggregated information (i.e., information about you and other users collectively, but not specifically identifiable to you) and other non-personal, de-identified, or anonymous information we collect, with third parties to optimize their ability to reach their target markets.

As Required by Law. We may be required to share your personal information with law enforcement or government agencies in response to subpoenas, court orders, federal/state audits or similar circumstances whenever we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.

Business Transfer. As with any other business, it is possible that we could in the future enter into a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale. If such a transaction occurs, the successor company would have access to the information maintained by us, including your personal information, but would continue to be bound by this Privacy Policy.

Your Rights and Choices

The CCPA provides Users (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Opt-Out from the Sale of Your Personal Information

You have the right to opt-out of our sale of your personal information to third parties. To exercise your right to opt-out of our sale of your personal information to third parties, please submit a verifiable User request to us by either:

  • Calling us at: 323-410-1052
  • Emailing us at: info@marketcall.net
  • Sending us U.S. mail to: 2015 Robin rd, San Marino, CA, 91108.

We endeavor to act on all opt-out requests as soon as practicable, but in all cases within fifteen (15) days of the receipt of your request.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable User request, we will delete (and direct our service providers to delete) your personal information from our (their) records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our obligations in connection with our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech rights, ensure the right of another User to exercise their free speech rights or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with User expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability and Deletion Rights

To exercise your access, data portability and/or deletion rights described above, please submit a verifiable User request to us by either:

  • Calling us at: 323-410-1052
  • Emailing us at: info@marketcall.net
  • Sending us U.S. mail to: 2015 Robin rd, San Marino, CA, 91108.

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable User request related to your personal information.

You may only make a verifiable User request for access or data portability twice within a 12-month period. The verifiable User request must:

  • Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable User request does not require you to create an account with us. We will only use personal information provided in a verifiable User request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We endeavor to respond to all verifiable User requests within forty-five (45) days of the receipt thereof. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the twelve (12) month period preceding the receipt of your verifiable request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable User request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; and/or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Changes to this Privacy Notice

We reserve the right to amend this Privacy Notice in our discretion and at any time. When we make changes to this Privacy Notice, we will notify you by email or through a notice on the Site’s homepage.
